Terms of Service
Welcome to nanoGOAT AAC. These Terms of Service ("Terms") govern your use of the nanoGOAT AAC application and related AAC support services (collectively, the "Service") provided by nanoGOAT LLC ("nanoGOAT," "we," "us," or "our"), a Colorado limited liability company.
By using the Service, you agree to be bound by these Terms. If you are a parent or guardian allowing a child to use the app, you agree to these Terms for your own use and for the use you authorize. If you do not agree to these Terms, please do not use the Service.
No account is needed to use the AAC app. Website accounts are governed by theWebsite Termsand are separate from the app's local communicator profiles. nanoGOAT Parent is a separate product governed by its ownTerms of Serviceand Privacy Policy. Parent's cloud sync does not sync AAC app content.
1. Description of Service
nanoGOAT AAC is an augmentative and alternative communication (AAC) application designed to help individuals, particularly children, communicate using customizable picture-based communication boards. The Service includes:
- The nanoGOAT AAC mobile application (available on iOS, Android, and Amazon Fire)
- On-device communication boards, stories, custom photos, and communicator profiles
- Backup and restore using files you control
- The AAC website pages and related support services
Everyday AAC use works offline. The current AAC app has no sign-in or cloud sync. Creating a website account does not upload, back up, or synchronize your AAC boards or photos.
2. Eligibility and Adult Setup
2.1 Website Accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an website account. The AAC app is designed for use by children under the supervision and with the consent of a parent or legal guardian. Children under 13 may not create accounts themselves.
2.2 Optional Website Use
If you choose to create a website account, you are responsible for maintaining the confidentiality of its credentials and for all activities that occur under your account. You agree to:
- Provide accurate and complete information when creating your account
- Keep your sign-in credentials secure and not share them with others
- Notify us immediately if you suspect unauthorized access to your account
- Accept responsibility for all activities conducted through your account
2.3 Parental Responsibility
If you allow a child to use the Service, you assume full responsibility for that child's use of the Service. You represent that you are the child's parent or legal guardian and that you consent to the child's use of the Service in accordance with these Terms and ourCOPPA Compliance Policy.
3. Free AAC App
3.1 Free Communication
We believe communication is a fundamental right. The AAC app is free and will remain free. It includes:
- Creating and using communication boards
- Customizing buttons with text, colors, and images
- Text-to-speech output
- Multiple user profiles on a single device
3.2 Separate Products
nanoGOAT Parent is a separate app for parents. A Parent subscription is not required to use AAC. Website accounts and Parent subscriptions do not unlock or restrict AAC communication.
4. User Content
Our commitment to your data
We do not sell, rent, trade, or share your personal information or family content with advertisers, data brokers, or other companies for their own marketing or independent commercial use. Your data is not a product we provide to others.
Service providers may process the information needed to operate, secure, and improve the services you use, as disclosed in the applicable Privacy Policy. We require those providers to limit their use to those services, not their own advertising or independent commercial purposes. We may also disclose information when you direct us to do so or when required by law. These limited purposes do not authorize selling your data.
4.1 Your Content
"User Content" means any content you create, upload, or share through the Service, including communication boards, custom images, button labels, and board configurations. You retain ownership of all User Content you create.
4.2 Local Content and Content You Send Us
Creating content in the AAC app stores it on your device; it does not upload it to nanoGOAT. If you choose to send us content for support, you grant nanoGOAT a limited, non-exclusive, royalty-free license to process that content solely to handle your request. We handle information you send us as described in ourPrivacy Policy.
4.3 Shared Content
You control where you save or send backup and export files. Anyone you give a file to may be able to read or import its content, including custom photos and profile information. Protect those files and share them only with intended recipients. The current app does not publish your boards through a nanoGOAT cloud-sharing service.
4.4 Content Standards
You agree not to upload or share User Content that:
- Is illegal, harmful, threatening, abusive, or harassing
- Contains sexually explicit material, especially involving minors
- Infringes on the intellectual property rights of others
- Contains malware, viruses, or other harmful code
- Violates the privacy of others
We reserve the right to remove content submitted to our online services that violates these standards and to suspend or terminate website accounts that repeatedly violate them. We cannot remotely access or remove content stored only in your AAC app.
5. Acceptable Use
You agree to use the Service only for its intended purpose — augmentative and alternative communication — and in compliance with all applicable laws. You agree not to:
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service or its infrastructure
- Use the Service to transmit spam or unsolicited communications
- Reverse-engineer, decompile, or disassemble the Service except where permitted by applicable law
- Use automated systems (bots, scrapers) to access the Service without permission
- Impersonate another person or entity
- Use the Service in any way that could harm children or vulnerable individuals
6. Intellectual Property
6.1 Our Property
The Service, including its design, code, graphics, user interface, logos, and trademarks (including the nanoGOAT name, Gigi, and Benny mascot characters), is the property of nanoGOAT LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute the Service except as permitted by applicable law, an applicable third-party license, or our written permission.
6.2 Feedback
If you provide suggestions or bug reports, you permit us to use them to improve our products without compensation. You retain ownership of your feedback. This does not authorize us to publish your family content or use your identity or review as an endorsement. Feedback is optional.
7. Medical Disclaimer
nanoGOAT AAC is a communication tool, not a medical device. The Service is not intended to diagnose, treat, cure, or prevent any medical condition or disability. It is not a substitute for professional speech-language pathology services, medical advice, or therapeutic intervention.
We encourage users to work with qualified speech-language pathologists and other professionals when developing communication strategies. The effectiveness of any AAC tool depends on individual circumstances, proper setup, and ongoing support from trained professionals and caregivers.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the Service will meet your specific requirements or expectations.
Because the Service may be used for communication by individuals with disabilities, we make every reasonable effort to ensure reliability. However, you should not rely on the Service as your sole means of communication in emergency situations.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NANOGOAT LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.
10. Indemnification
You agree to indemnify, defend, and hold harmless nanoGOAT LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- Your violation of these Terms
- Your violation of any third-party rights
- Any User Content you create or share through the Service
11. Termination
11.1 By You
You may stop using the AAC app at any time. You manage local AAC data through the app and your device's storage controls. You must manage any separate backup or export copies yourself. Deleting a website account does not delete local AAC data, and uninstalling the AAC app does not delete a website account. Information held by nanoGOAT is handled in accordance with ourPrivacy Policy.
11.2 By Us
We may suspend or terminate your access to the Service at any time if you violate these Terms, engage in abusive behavior, or if we reasonably believe it is necessary to protect the Service or its users. We will make reasonable efforts to notify you before or at the time of termination, except where immediate action is required.
11.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including sections on intellectual property, disclaimers, limitation of liability, and indemnification) will continue in effect.
12. Dispute Resolution
12.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions.
12.2 Informal Resolution
Before filing any formal proceeding, you agree to try to resolve any dispute informally by contacting us athello@nanogoat.io. We will try to resolve the dispute informally within 60 days.
12.3 Jurisdiction
If informal resolution is unsuccessful, any legal action or proceeding shall be brought exclusively in the state or federal courts located in the State of Colorado. You consent to the personal jurisdiction of these courts.
If you are located outside the United States, you may have additional rights under your local consumer protection or data protection laws that cannot be waived by contract. Nothing in these Terms is intended to limit those statutory rights.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will:
- Update the "Effective Date" at the top of this page
- Post notice on this website at least 30 days before material changes take effect and provide any additional notice required by law
- Give you the opportunity to review the changes before they become binding
Your continued use of the Service after the effective date of revised Terms constitutes acceptance of the changes. If you do not agree with the revised Terms, you must stop using the Service.
14. General Provisions
- Entire Agreement — These Terms, together with our Privacy Policy and COPPA Compliance Policy, constitute the entire agreement between you and nanoGOAT regarding the Service.
- Severability — If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Waiver — Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.
- Assignment — You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
- No Third-Party Beneficiaries — These Terms do not create any third-party beneficiary rights, except as expressly stated herein.
